NOTICE OF OPPORTUNITY
JUSTICE OF THE PEACE
PRO TEMPORE

POSITION INFORMATION

Justices of the Peace pro tempore justices shall be the alternative conservators of the peace in their respective townships and shall discharge such duties as may be prescribed by law, per NRS 4.170.  The Nye County Board of County Commissioners may select a number of persons it determines appropriate to comprise a panel of justices of the peace pro tempore.

DUTIES 

NRS 4.340 provides for the temporary assistance for a Justice of the Peace whenever ill health, absence, or other cause prevents the Justice from attending to his or her official duties.  In such instances, the Justice of the Peace shall, if necessary, invite other qualified Justice of the Peace of another county or appoint a person from a panel of justices of the peace pro tempore to attend to his or her official duties, including those of registry agent. 

Justices of the peace pro tempore provide temporary assistance to Justice of the Peace in the attendance of his or her official duties to include, but not limited to:

  • Administer oaths or affirmations
  • Issue subpoenas and final process
  • Misdemeanor trials
  • Preliminary hearings
  • Motion hearings
  • Small claims hearings
  • Civil trials and hearings
  • TPO hearings – Bail hearings
  • Probable cause reviews
  • Administrative reviews
  • Determine eligibility for public defender appointments
  • Issue warrants

QUALIFICATIONS

The persons so selected must have a high school diploma, or equivalent, be a qualified elector; and attend applicable judicial training at the next available opportunity (scheduled for June 2025).

Those interested in being considered to serve in the capacity of Justice of the Peace Pro Tempore must submit a letter of interest by 5:00 p.m., December 6, 2024. Within the letter of interest, the applicant should attest that they meet the qualifications listed above, state why they are interested in the position, and set for any conflicts of interest that may prohibit them from acting as justice of the peace.

Please submit your letters of interest to Nye County Administration in person at 2100 E. Walt Williams Dr., Suite 100, Pahrump, NV 89048, or email at NyeAdmin@nyecountynv.gov.  No letters of interest will be accepted after 5:00 p.m. on December 6, 2024.
