  • The cost of meals shall be reimbursed based upon the applicable per diem rate for meals expenses as shown on the US General Services Administration web site (www.gsa.gov/mie), based on the per diem rates for the travel destination. Nye County does not reimburse for incidentals. Mileage rates for 2024 are 0.670 cents per mile if no county car is available, 0.335 cents for convenience.

  • Under the Temporary Use section of Nye County Code HERE you will find all the short-term, seasonal or limited period of times on a particular lot or parcel. 

    Recreational Vehicle, Temporary Seasonal Use: A recreational vehicle within all residential zoning districts shall be allowed as a temporary, seasonal use for a maximum of one hundred twenty (120) calendar days per calendar year without a temporary use permit. Occupancies exceeding seven (7) consecutive days shall require connection to an approved permanent wastewater disposal system (i.e., individual septic system or public sewer system) and an approved permanent water supply (i.e., private domestic well or public water system).

Appeals must be filed in writing with the Planning Department within 30 days from the PRPC meeting and are scheduled for a hearing by the BOCC approximately one month later.   • The Master Plan, or Land Use Plan, is an overall development guide for all areas of the Pahrump Regional Planning District. It provides the appropriate mix of residential, commercial, and industrial uses in a logically transitioned pattern. It is used to decide if proposed development is in conformance with the plan. Zoning is the division of the county into districts for the purpose of regulating the use of private land. It is, also, a legal entitlement to develop your property within the permitted uses specified in the zoning code. (This only applies to the Pahrump Regional Planning District)

  • To obtain a Flood Elevation Certificate application and obtain a Floodproofing Certificate for Non-Residential buildings select the links or visit the FEMA website. Elevation data reported on a FEMA Elevation Certificate must be certified by a licensed surveyor, Engineer or Architect. This document is reference in the NFIP Flood Insurance Manual (Special Certifications Section.) 

    You must also apply for an Elevation Certificate review with Nye County Planning  HERE. A wet stamp hard copy must be dropped off at the Nye County Planning Department and a $75.00 fee paid prior to the commencement of the Flood Plain Administrator review.

  • Yes, you can have more than one Home-Based Business in your home as long as you comply with the Home Occupations section of the Zoning Ordinance (NCC 17.04.800).

  • Property development in the Pahrump Regional Planning District is governed by Title 17 of the Nye County Code. This code governs all property development and land uses. You can also speak with a Planner to ask specific questions to ensure that your project will comply with the Development Code. You can find the code by following this LINK.

  • Demonstrating compliance with the Development Code is a required step for all building permits. This ensures that any use you make of your property will not have a negative impact on neighboring properties or property values. Even when a building permit is not required, all structures must meet Title 17 of the Nye County Code requirements. You must obtain an approved Zoning Review Application  HERE prior to the start of ANY construction

  • Specific property zoning can be determined by visiting the Planning Department or visiting the Nye County Assessor data search (This only applies to the Pahrump Regional Planning District). 

    The field showing ZONING is what your property is zoned. For example NC for Neighborhood Commercial. Do not pay attention to the Land Use code the Assessor's Office shows. That is for tax purposes. 

    Property zoning determines what a property can be used for and the applicable development standards such as setbacks, height restrictions, etc. Planning staff can discuss the zoning rules and specific requirements for developing a parcel. Zoning information is also available online with the Nye County GIS interactive Map.

  • The Board of County Commissioners (BOCC) are elected officials who are responsible for establishing and maintaining the governance of unincorporated Nye County, including land development. The BOCC are elected from five electoral districts and appoint the members of the Regional Planning Commission. The Pahrump Regional Planning Commission is empowered by the BOCC to make final development decisions on many land use applications, and make recommendations on nonconforming zone change requests. The BOCC is the final authority on all zoning issues, including appealed decisions from the PRPC.

  • Generally, any new construction of a structure over 200 square feet or anything in a commercial zone will require a building permit. If your structure is UNDER 200 Sq Ft you are required to obtain a Zoning Review application, regardless if building permits are required. 

    Appropriate building, electrical, plumbing, mechanical, pool, and/or other permits are required for all new construction, alteration, repair, moving, improving, removing, conversion, or demolition of buildings, structures, signs, amusement, and transportation systems, or building service equipment as outlined in the Nye County Code. (This only applies to the Pahrump Regional Planning District)

  • If your property is within the 100-year flood plain, in zones AO-1, 2, or 3 in an Undefined A-Zone, your mortgage company will likely require flood insurance. Otherwise, flood insurance is not mandatory. However, the decision to purchase Flood Insurance from the National Flood Insurance Program must be made by each individual. You can get more information from the FEMA website or from your insurance agent.

  • A conceptual Site Plan is required with all Conditional Use Permit applications and must comply with NCC 17.04.950 before going before the Regional Planning Commission for action. If the application is approved, then a full Site Development Plan Review will be required and must be approved by both the Planning Department and Public Works Department before any construction or development will be permitted, as well as before a Certificate of Occupancy will be issued from the Building and Safety Department. (This applies only to the Pahrump Regional Planning District)

  • It is intended that Site Development Plan reviews shall be required prior to the issuance of Building or other Construction Permits for all properties located in the (NC) Neighborhood Commercial, (GC) General Commercial, (MU) Mixed Use, (MF) Multi-family, (LI) Light Industrial, (HI) Heavy Industrial, (BR) Brothel, and (AP) Airport Zones and is required for all commercial/industrial development.

  • Public Comment during the Commission Meeting will be for all matters off the agenda and will be limited to up to three minutes per person. Additionally, public comments of up to three minutes per person may be heard during individual action items. The Commission reserves the right to reduce the time allowed for public comment. The Commission may prohibit comment if the content of the comments is a topic that is not relevant to, or within the authority of, the Commission or if the content of the comments is willfully disruptive of the meeting by being irrelevant, repetitious, slanderous, offensive, inflammatory, irrational or amounting to personal attacks or interfering with the rights of other speakers. Persons are invited to submit comments in writing on the agenda items and/or attend and make comments on that item at the Commission meeting. 

    Decorum during the meeting must be upheld pursuant to the BOCC Rules of Procedure sections 7.5.3 and 7.5.4 whereby no person in the audience shall engage in disorderly conduct such as hand clapping, stamping of feet, whistling, using profane language, yelling, and similar demonstrations, which conduct disturbs the peace and good order of the meeting. Any person who becomes disruptive or interferes with the orderly business of the Board may be removed from the Board Chambers or other meeting rooms for the remainder of the meeting.

    Once the complaint is received it will be reviewed and you will be able to track the process the entire way from beginning to end without needing to contact the Code Compliance officer for updates.

  • If you have received a Code Enforcement Violation Notice, you either own or are otherwise 'in control' (i.e. live in, lease, or manage) a property that has been found to have violations of the County, or Town ordinances or other adopted codes. 

    The first thing you should do is read the Notice. The Notice will tell you the address of the violation property, when the violations were observed by the Code Enforcement Officer, and what violations were present when the Code Officer made their inspection. Next, contact the Code Enforcement Officer named on the Violation Notice. Their phone number is on the notice. The Code Enforcement Officer can usually answer any question you may have about the property and the violations observed at the time of the inspection. Lastly, remediate the violations! The Code Enforcement Officer will work with you if you need time to comply the cited violations of the City Code. You may call the Code Enforcement Officer if you need a short extension, or contact the Director of Planning for requesting a longer extension. Non-compliance of the Violation Notice Failure to comply with a Code Enforcement Violation Notice is punishable by both criminal and civil penalties! 

    Criminal Penalties: Violations of the adopted codes and Ordinances are Misdemeanors. These violations are punishable by fines of up to $1,000 (not including court costs) and/or up to 6 months in jail, each day the violation exist constitutes and additional fine. Civil Penalties: Any cost incurred by the county for property remediation will be levied on the respective properties as a special assessment tax and shall be added and be collected with other taxes in the assessment roll in the same manner as other county taxes and shall continue to be a lien on the property until paid.

  • You may consider scheduling a court appearance to plead NOT GUILTY. The not guilty plea form  may be obtained from our forms page and  submitted by mail, fax or email. Prior to entering your Not Guilty plea to the court, you may want to contact the Nye County District Attorney’s office for possible plea negotiations. By negotiating a plea agreement, a traffic trial is avoided. If the District Attorney and the Defendant are unable to reach an agreement, then a trial date in front of the Justice of the Peace will be set. All Defendants, including non-local individuals, must appear in person or authorize an attorney to represent them at these proceedings.

  • Please contact the court.  The court may grant you a one time,  30 day extension to pay your traffic citation.  The court also offers payment plans ($25 fee) with a minimum payment amount of $50/month, if you are unable to pay in full by your due date. You also have the option of performing community service in lieu of paying the fine/fees with a court approved, non-profit organization at the rate of $10/hour. If you complete community service without getting the court's approval, it may be denied by the Judge.

  • For any project involving an aggregate one-half acre or more of Disturbed Area, a Dust Control Plan must be submitted to the Nye County Air Quality Program Administrator along with the zone review, building permit application, conditional use permit application, zoning change application, or site development plan. The Dust Control Plan shall specify the use of Best Practical Methods to control the generation of fugitive dust from each construction activity.

  • Any person engaged in activities involving the handling, transportation or storage of any material; dismantling or demolition of buildings; grubbing; grading; clearing of land; public or private construction; the operation of machines and equipment; the grading of roads; trenching operations; the operation and use of unpaved parking facilities; and the organization and supervision of public outdoor events shall take all reasonable precautions to prevent fugitive dust from becoming airborne from such activities at all times. Reasonable precautions may include, but are not limited to, sprinkling, compacting, enclosure, chemical or asphalt sealing, cleaning up, sweeping, soil amendments, addition of non-emissible covers or such other measures as Nye County may specify. All control measures selected must be maintained to ensure the visible emissions do not exceed the 20% capacity limit as described in Section 15.28.150.A of the county dust regulation.

  • This Regulation shall not apply to emergency activities conducted by any Fire Department, utility, or government agency that are necessary to protect the health, safety, and welfare of the public. The following construction-type activities do not require a Dust Control Plan: 

    1. Landscaping by an individual at his/her place of residence; 
    2. Emergency maintenance activities conducted by government agencies on publicly maintained roads, road shoulders, rights-of-way and on public flood control facilities; and 
    3. Dust Palliative application projects conducted solely for the purpose of compliance with Open Areas and Vacant Lots subsection of this ordinance, wherein no grade elevation changes, no soil or rock is imported or exported, or no cut and fill operations occur. Importing of gravel or rock for use as a dust palliative is allowed under this subsection.
